Jobstream™ — Creator Terms of Service & Participation Agreement

This Creator Terms of Service & Participation Agreement ("Agreement") is between Predictable Source LLC d/b/a Jobstream™ ("Jobstream," "we," "us") and the individual or entity that clicks "I Agree," creates an account, or uses the Services ("Creator," "you"). By doing so, you agree to this Agreement and our Privacy Policy (together, the "Policies"). We retain the right to change and update our terms of service at any time. At a glance (non-binding): Jobstream™ operates as an intermediary technology platform that connects brands, employers, advertisers, and other business individuals or entities that advertise, promote, or market jobs, products, and services. Our primary role is to facilitate a relationship between Brands and influencers or creators, allowing for an easy exchange of promotional opportunities, commissionable sales, and other collaborations.
- You share Jobstream™ joblinks.
- You earn a Commission per Valid Application (default 15%-30%, unless a job displays a different CPA or payout).
- We pay monthly up to Net 45 after month-end, once your approved balance is a minimum of $100+.
- Only U.S.-submitted applications are eligible.
- Job applications must be submitted while a joblink is active (or within 24 hours after it's pulled), within 30 days after you post the job.
1) Definitions
- "Channels": Your distribution surfaces (e.g., Youtube, TikTok, Instagram, LinkedIn, Twitter/X, Reddit, Facebook, newsletters, Slack/Discord communities, websites).
- "Joblink": A unique, trackable link generated by the Services for a specific job.
- "JobTree™": the "Linktr.ee" of creator curated jobs, an optional product with a unique URL customized and personalized by the creator.
- "The Career Creator Network™": The community in which we refer to as Jobstream™ career creators who have been accepted and have opted in to our terms of service.
- "Creatorpreneur™": What we refer to as the business of a creator who has made their creator business a side hustle or full time career.
- "Valid Application": An application that (a) begins from your Joblink; (b) is submitted to the employer's ATS/job system; (c) is not withdrawn within 72 hours; (d) is unique for the applicant+job pair (earliest eligible application wins); (e) is not fraudulent, incentivized, or bot traffic; and (f) is submitted while the job is active, or within 24 hours after the job is removed.
- "Commission": The amount payable per Valid Application (default 15%-30% unless a job's page displays another CPA).
- "CPA": Cost per application. Refers to the payout associated with applications submitted to a certain role.
- "Services": Jobstream™'s platform, tools, APIs, dashboards, and related services.
2) Acceptance
These Terms constitute a binding legal agreement between you, or if accepting on behalf of an entity, such entity (in either case, referred to as "you", "your") and Jobstream™. By completing and submitting your Application you agree to be bound by these Terms. You also understand that any activity with Jobstream™ represents your acceptance of and agreement to comply with all of these Terms. If you are accepting the Terms on behalf of a company or other entity, you represent and warrant that you have authority to bind such company or other entity to these Terms.
3) Application to Jobstream™
To apply for Jobstream, you must submit to us a complete and accurate Application, including your relevant contact information, and the name and handle of your profile on the relevant platform, and/or URL of your website, blog, social media presence, blog, and/or other platforms (and your presence on such platforms) that you wish to enroll in Jobstream™. We will evaluate your Application and notify you whether you are accepted. We may reject your Application for any or no reason, in our sole and absolute discretion, including but not limited to a failure to meet the Eligibility Requirements set forth below. Note that if we accept your Application and later determine that your creator profile is unsuitable or that you fail to meet the Eligibility Requirements or comply with these Terms, we may terminate your participation in Jobstream™ effective immediately.
Identity verification. By submitting an Application, you represent and warrant that the social media and other accounts listed in your Application belong to you and that all information you provide is true, current, and complete. We reserve the right, at any time and in our sole discretion, to request additional information or documentation to verify your identity, your ownership and control of your Channels, and your eligibility, including but not limited to government-issued identification, proof of address, proof of account ownership, or other verification we deem appropriate. We may use third-party identity-verification, social-screening, and fraud-detection services for this purpose. We may suspend, withhold approval of, pause Joblinks for, or terminate any account that fails, refuses, or delays such verification, or that we reasonably believe involves false, stolen, synthetic, or misrepresented identity information.
One account; no credential sharing. Each account is for a single, identified human or authorized entity representative. You may not share, sell, transfer, or allow any third party to access your account or credentials, and you are responsible for all activity occurring under your account. You must keep your credentials confidential and notify us immediately at help@getjobstream.com if you suspect any unauthorized access to or use of your account.
4) Eligibility & Qualifying Criteria for Career Creators on Jobstream
- There is an onboarding period for creators.
- Assessment during onboarding of: traffic authenticity, FTC disclosure compliance, content–role fit, and application quality (completion rates, duplications, obvious fraud).
- We may request sample posts/placements or short trial placements; creators agree to promptly edit or remove non-compliant placements.
- Persistent low-quality or non-compliant traffic may result in paused Joblinks, denial of Commissions for invalid traffic, or termination.
- Quality evaluation continues after onboarding to protect marketplace integrity.
- US-only (for now) or based in US across Social Accounts & Followers.
- In a position of professional influence, or you are already creating job and/or work content.
- Have a trusted follower base of 10,000+ across social media platforms, or a newsletter community.
- You view yourself as a creator, and may participate in affiliate marketing across other platforms like LTK, or ShopMy.
- Other career creators include, not limited to: recruiters, career coaches, social media influencers, schools, associations, alumni groups, niche networks or labor or trade programs.
- To preserve a positive and ethical community, participation is subject to content review and alignment with our standards.
- For clarity, we reserve the right to refuse entry, terminate, or discontinue access for any reason, including hate speech, derogatory content, or behavior that violates our community guidelines.
- Ongoing eligibility & re-screening. Acceptance is conditional and continuing. We may reverify, re-screen, or re-assess your identity, Channels, traffic, and conduct at any time during your participation, including through periodic monitoring and third-party screening services. Continued eligibility requires that you remain in compliance with these Terms and our standards at all times; we may immediately pause, suspend, or terminate access if you no longer meet our eligibility or vetting criteria.
5) Program Scope; U.S.-Only
Our Joblinks are only relevant to U.S. audiences. Only U.S.-sourced traffic and applications are eligible for Commission. We may geo-filter and reject non-U.S. activity.
Sanctions & export compliance. You represent and warrant that neither you nor any individual or entity associated with your account is located in, organized under the laws of, or ordinarily resident in any country or territory subject to comprehensive sanctions, and that you are not identified on any sanctions or restricted-party list administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), the U.S. Department of Commerce, the United Nations, the European Union, or the United Kingdom. You agree not to access or use the Services in violation of any applicable export control or sanctions laws. We may block, suspend, or terminate access to comply with these laws or to protect the platform from prohibited or high-risk activity, including activity originating outside the United States.
6) How Jobstream™ Works
- Discover jobs on the Jobstream™ platform and generate commissionable or trackable Joblinks and optional creative.
- Share Joblinks in your Community or social channels with clear disclosures according to the policy of the third parties platform. To learn more about third party on-platform policies, visit the channels individual terms and conditions policies.
- We track clicks and applications and determine Valid Applications under this Agreement.
- Commission tracking will be sent to you on a weekly basis.
- Details about pay out are in a following section.
7) Attribution, Dedupe, and Eligibility
- Earliest-wins dedupe. If the same applicant applies to the same job via multiple links/creators, the earliest timestamped eligible application is credited.
- Job removal window. After a job listing is removed, only applications submitted within 24 hours remain eligible; later submissions are not payable.
- Attribution. Applications submitted within 30 days of you posting the link will be attributed to your Jobstream™ account.
- Fraud/invalid traffic. We void incentivized applies, bots, fake identities, stolen PII, misrepresentation, or activity that circumvents tracking.
- Stale inventory. We may invalidate applies from obviously stale pages or redirected postings where the CPA/job materially changed without an updated Joblink.
- Quality. We will track the quality of applications received over time and if we note that your channel is providing low quality applications, Jobstream™ may reconsider the agreement.
8) Creator Responsibilities
Jobstream™ is an affiliate content technology platform that includes attributable job links. Our approach is grounded in the Federal Trade Commission's advertising and marketing guidelines, with a strong focus on transparency and trust. We're here to support creators in partnering with Jobstream™ in a clear, compliant, and audience-first way. While creators are always responsible for understanding and following the policies of each social community or platform that they publish on, our role is to help make compliance simple and intuitive—so creators can maintain credibility with their audience. Creators earn commission when their followers click and apply through Jobstream™ links. Each link includes secure tracking that allows us to accurately attribute applications, calculate earnings, and protect the integrity of the platform through fraud and bot detection. All links and applications are validated to ensure ethical, high-quality engagement—creating a system that works for creators, employers, and job seekers alike. For avoidance of doubt, in no circumstances, our affiliate links may not be modified by the creator.
As a Jobstream™ career creator, you are agreeing to create factual, ethical trustworthy content, and for clarity, not taking any facts out of context, distorting the information, or making any claims about jobs, pay, or hiring guarantees.
- Compliance. Follow all laws and platform rules for each individual publishing entity (e.g., TikTok/Instagram, Newsletter), including FTC endorsement disclosures (e.g., "#ad") about general use of affiliate links.
- Accuracy. Don't make misleading claims about jobs, pay, or hiring guarantees.
- No applicant PII. Your role as a Career Influencer creating with Jobstream™ content is to serve as the content creator solely, between your audience, and the links provided from our network. For clarity, you should not request, collect, store, or use applicant personal data; applicant data and candidate application status belongs to the employer.
- Brand safety. No unlawful, discriminatory, hateful, adult, or deceptive content.
- No sub-affiliates or resale of Joblinks without our written approval.
- No reposting our job links to third party owned job boards or entities. For clarity this means you may not post our job links into a Recruiter Open Job LinkedIn job listing slot, or repost the job to Indeed, or any other entities job board, except for one owned by the creator.
Note: We recommend you check the official Federal Trade Commission resource for updates to policies, or regulatory change and familiarize yourself with the latest policies for creating commercial content. It is your responsibility to understand the variances and commercial terms of each platform that you choose to share content.
Prohibited content (non-exhaustive). In addition to the above, you agree that you will not create, post, distribute, or transmit through or in connection with the Services any content or material that: is false, misleading, defamatory, libelous, or tortious; is threatening, abusive, harassing, bullying, vulgar, obscene, sexually explicit, violent, or that incites violence; is hateful or discriminatory on the basis of race, color, religion or creed, national origin or ancestry, sex, age, physical or mental disability, veteran status, sexual orientation, pregnancy, or gender identity; discloses or “doxxes” another person's private or personally identifiable information without authorization; infringes or misappropriates any third party's intellectual property, privacy, or publicity rights; promotes contests, sweepstakes, multi-level marketing, Ponzi or pyramid schemes, cryptocurrency, or other prohibited offers; contains viruses, malware, or any code designed to disrupt or impair the Services; constitutes spam, chain messages, or unsolicited mass communications; provides material support to any organization designated by the U.S. government as a terrorist organization; or that we otherwise deem harmful, unlawful, or objectionable in our sole discretion.
Harassment & respectful conduct. We are committed to a safe, respectful, and professional environment for our team, our partners, employers, job seekers, and other creators. You agree not to harass, threaten, intimidate, stalk, abuse, defame, or send rude, offensive, or hostile communications to any Jobstream™ personnel, partner, employer, applicant, or other creator, through any channel. We reserve the right to immediately suspend or remove from the Services any creator who engages in such conduct, and to report threatening or unlawful conduct to the relevant social or messaging platform and, where appropriate, to law enforcement.
No interference, scraping, or unauthorized access. You agree not to, and not to attempt to or permit others to: (a) access the Services, any account, or any data without authorization, or use another person's account or credentials; (b) use any bot, spider, crawler, script, scraper, or other automated means to access, harvest, or scrape data from the Services, including ATS or applicant pages, user lists, or any portion of a database; (c) introduce viruses, malware, ransomware, or any harmful code, or take any action that imposes an unreasonable or disproportionately large load on, disrupts, or impairs the Services or their infrastructure; (d) probe, scan, or test the vulnerability of, or breach or circumvent, any security, authentication, rate-limiting, geo-filtering, or tracking measure of the Services; (e) reverse engineer, decompile, or disassemble any part of the Services or attempt to derive source code; (f) frame, mirror, or misappropriate any Jobstream™ trademark, logo, or proprietary material, or register any domain name confusingly similar to our marks; or (g) provide false information to sabotage, manipulate attribution, or otherwise negatively affect the Services. You must promptly report to us any actual or suspected security vulnerability, data incident, or unauthorized access of which you become aware, and cooperate with any resulting investigation.
9) Compensation, Payouts, and Adjustments
- Basis. Unless a job page displays a different amount, the Commission is 15%-30% per Valid Application, depending on the CPA of the job. If a job displays a specific CPA, that job-level CPA governs for that job. CPAs may vary by job.
- Schedule & threshold. We pay monthly up to Net 45 after month-end, once your approved balance is a minimum of $100+.
- Contingency. We pay Commissions only for Valid Applications for which we have actually received payment from the relevant employer or partner. If such payment is delayed, reversed, or withheld, we may correspondingly delay or adjust your payout.
- Adjustments. We may reduce, deny, or claw back Commissions for invalid/duplicate/fraudulent activity; late applies beyond eligibility; employer disputes; refunds/chargebacks; or manifest errors.
- Forfeiture on violation. In addition to any other remedy, if your account is terminated or suspended for cause — including fraud, breach of these Terms, prohibited conduct, harassment, security violations, or misrepresented identity — we may withhold, cancel, or claw back any Commissions, referral bonuses, or other amounts otherwise owed to or accrued by you, whether or not previously deemed “Valid,” to the fullest extent permitted by law.
- No off-platform activity. You may not take Jobstream-sourced CPA deals off the Jobstream™ platform. Circumvention may result in suspension and a reasonable administrative fee. For clarity, this means not posting on other third-party owned job boards, such as Indeed or LinkedIn.
- Taxes. You're responsible for your taxes; we'll issue a 1099-NEC where required. You agree to pay all applicable taxes, including any applicable value added tax (VAT) or other similar taxes, imposed by any government entity in connection with your activity with Jobstream™. You are solely responsible for providing and maintaining accurate contact and payment information in connection with your activity with Jobstream™. U.S. taxpayers must provide, among other information, a valid U.S. tax identification number and a fully completed Form W-9. Non-U.S. taxpayers must provide either a fully completed Form W-8 or other form, which may require a valid U.S. tax identification number, and signed certification that the taxpayer does not have U.S. activities as required by the U.S. tax authorities.
- Questions. Any questions or claims by you regarding any charges or payments must be raised with us in writing within sixty (60) days after the date such charges are accrued or payments issued, or else the charges or payments will be deemed final and will not be subject to any further claims or disputes. No refunds, credits or other billing adjustments will be made if a question or dispute is not asserted by you in writing within sixty (60) days of the date on which the applicable charges are accrued or payments issued. Payment shall be calculated solely based on records maintained by Jobstream™.
10) Referral Program Rules & Qualifications
How the Jobstream™ Referral Program Works
Jobstream™ is an invitation-only talent network. Every creator on the Jobstream™ platform is here because someone vouched for them, or because we sought them out.
Know a creator who belongs here? Refer them, and if they're accepted and complete their first qualified share, check the referral page in the dashboard to view the referral reward.
Here's how it works:
- Share your unique referral link with a creator you think would thrive on Jobstream
- They apply using your link
- Our team reviews their application (typically within 2-5 business days)
- If accepted, they complete onboarding and share their first job opportunity
- Once that first converted applicant is verified, you each are rewarded the amount stated in the dashboard (for them, and for you)
When payment is granted:
Your referral bonus is issued when:
- Your referral is accepted to the Jobstream™ platform, AND,
- They complete their first qualified job application from sharing within 30 days of acceptance
Payment is processed within 14 business days of qualification via our secure fintech platform Tremendous, which will be sent via email.

Who We're Looking For
We're intentional about who joins Jobstream™. This is a curated community of creators who've built real trust with their audiences, and who want to use that trust to help people find meaningful work.
To be considered, creators should have:
- An established audience — 5,000+ followers on at least one community channel or platform (Instagram, TikTok, YouTube, LinkedIn, Facebook, or a newsletter/blog with engaged subscribers)
- Niche expertise or professional credibility — your audience comes to you for insight on career, industry, or professional life. This could be healthcare, tech, trades, finance, education, creative fields, or any space where people trust your perspective on work and opportunity.
- Real engagement — we care more about community trust than follower count. Creators with smaller, highly engaged audiences are absolutely welcome.
- U.S.-based (for now—we're expanding soon)
- Genuine intent — We're looking for creators who are excited to connect their audience with real opportunities. Creators who think: "How can I support my community", or "What value can I give to my followers to keep them engaged and thriving."
Not sure if someone qualifies? When in doubt, send them our way. We'd rather review a borderline application than miss a great creator.
11) Privacy & Data
We process your account, contact, and payout information in accordance with our Privacy Policy. Job applicant information submitted through Joblinks belongs to the employer or hiring company and is processed by Jobstream™ on their behalf. You have no rights in applicant data and may not attempt to access, copy, or misuse it. We record limited attribution metadata (click → apply events) to operate billing, analytics, and payouts. We implement commercially reasonable safeguards to protect personal data.
SMS / text-message consent. By providing your mobile phone number to Jobstream and accepting these Terms (and, where presented, by separately opting in), you consent to receive recurring text (SMS/MMS) messages from us and our service providers at that number, including messages sent using an automatic telephone dialing system or automated technology. These messages may include account, verification, onboarding, payout, and other transactional or service notifications, as well as program updates, new opportunities, and marketing or promotional messages. Consent to receive marketing texts is not a condition of participating in the program or receiving the Services. Message frequency varies. Message and data rates may apply. You can opt out of text messages at any time by replying STOP to any message, and you can reply HELP for help; opting out of marketing texts may not stop transactional messages necessary to operate your account. You represent that you are the owner or authorized user of the number you provide and agree to notify us if it changes. Carriers are not liable for delayed or undelivered messages. How we collect, use, and share phone numbers is further described in our Privacy Policy.
Data security & incident cooperation. We maintain administrative, technical, and physical safeguards designed to protect personal data, but no system is perfectly secure and we do not guarantee absolute security. You agree to handle any data you encounter through the Services responsibly, to never attempt to access, export, copy, or retain applicant or other user data outside your authorized use, and to promptly notify us at help@getjobstream.com and cooperate fully with us if you become aware of any actual or suspected security incident, data breach, account compromise, or unauthorized access. We may suspend access, reset credentials, or take other protective measures at any time to investigate or contain a suspected security incident.
Record retention. Even after your access is suspended, under review, terminated, or your account is deactivated, we may retain certain records including your acceptance of these Terms, consent records, attribution and payout history, and information needed for legal, tax, audit, fraud-prevention, and compliance purposes — for as long as reasonably necessary or as required by law. Deactivation or removal of your access does not delete or invalidate these retained records.
12) Term; Suspension; Termination
- Term. Effective while you use the Services.
- Convenience. Either party may terminate with 15 days' written notice.
- Updates. If you don't accept updated terms, you may terminate on 5 days' notice within 10 days of our notice.
- Cause. We may suspend/terminate immediately for breach, fraud, or platform risk.
- Termination for any reason. Notwithstanding anything to the contrary, we reserve the right, in our sole and absolute discretion, to suspend, restrict, deactivate, or terminate your access to and use of the Services, in whole or in part, at any time, with or without prior notice, and with or without cause or justification — including for any reason or no reason. We are not obligated to provide a reason for any such action. Our exercise of this right shall not give rise to any liability to you or any third party
- Immediate suspension pending investigation. We may immediately suspend or pause your account, Joblinks, payouts, or access — before any final determination — while we investigate suspected fraud, breach, harassment, a security incident, unauthorized or compromised access, misrepresented identity, or any other conduct we believe may harm the Services, our team, our partners, employers, applicants, or other creators, or that poses legal, reputational, brand-safety, or platform risk.
- Security & unauthorized access. We may immediately suspend or terminate, block, and revoke all access if we reasonably believe your account has been compromised, accessed by an unauthorized party, used to access or exfiltrate data without authorization, or used in any way that threatens the security or integrity of the Services or the data of any user, applicant, employer, or partner. We may also take any technical measures necessary to protect the platform, including disabling credentials, blocking IP addresses or devices, and removing content or links.
- Enforcement actions; reporting. Upon or in connection with any termination or suspension for cause, we may (in addition to our other rights) remove or disable your content and Joblinks, withhold or claw back amounts as described in Section 9, retain records as described in Section 11, report unlawful or threatening conduct to the relevant social or messaging platforms and to law enforcement or other authorities, and pursue any remedies available at law or in equity.
- Sunset, not deletion. For legal and compliance reasons, terminating or deactivating your access does not require us to delete your account record or your historical data; we may instead retain your account in an inactive or “sunset” state and preserve your acceptance of these Terms and other records as described in Section 11.
- Effects. Valid Applications recognized before termination remain payable if recorded within 30 days of termination (unless termination was for cause). Stop using Joblinks and remove our tools/content upon termination. If you terminate your participation for convenience, any Valid Applications recorded prior to termination will be payable in accordance with the regular payout schedule, provided you remain in good standing.
13) Indemnification
You hereby agree to defend, indemnify and hold Jobstream, its Affiliates and Merchants and each of their respective directors, officers, employees, contractors, and licensors ("Indemnified Parties") harmless from any and all claims, liabilities, costs and expenses, including reasonable attorney's fees and costs, that the Indemnified Parties may suffer as a result of: (a) claims that arise from or relate to your participation in the Program or any other Jobstream™ service; (b) any breach by you of these Terms or of any representation made by you or obligation entered by you hereunder; or (c) any claim of violation of a third party's privacy rights, or any third party claim relating to your Site or any content thereon, including any claim of infringement or misappropriation of any other party's intellectual property or proprietary rights. You shall not enter into any settlement or admit any fault or liability that affects any Indemnified Party without that Indemnified Party's prior written consent.
14) Intellectual Property Rights
- Our IP. The Services, tools, and templates are Jobstream™'s IP. You receive a limited, revocable license to use them to participate in the program.
- Your IP & "publicity rights." You keep your content. "Publicity rights" here means: you grant Jobstream™ a limited, royalty-free license to use your name, handle, and/or logo solely to identify you as a participating Creator (e.g., on our website, case studies, sales materials). You can opt out any time by emailing help@getjobstream.com; we'll stop future use (already printed materials/campaigns may persist).
- DMCA. If you believe content on the Services infringes your copyright, submit a notice per our DMCA Policy.
You acknowledge our exclusive right, title, and interest in and to the service mark Jobstream™ and all other trademarks, service marks and trade names associated with the Jobstream, including all content on our web sites ("GetJobstream"). You acknowledge and agree that you shall not have or obtain any rights in any of the Jobstream, and that you will not adopt, use or attempt to register any trademarks or trade names that are confusingly similar to the Jobstream™ nor will you purchase or use in any manner any of the Jobstream™ in your search engine or other marketing activities. You agree that you will not dispute or contest Jobstream™ and where applicable its Affiliates or licensors exclusive ownership of all or any part of the Jobstream™. We reserve all rights not expressly granted in these Terms and no implied licenses are granted.
15) General
- Independent contractors. The parties are independent.
- Assignment. You may not assign without our consent; we may assign freely.
- Confidentiality: You may receive non-public or proprietary information about Predictable Source, Employers, or other partners through Jobstream™ ("Confidential Information"). You agree not to disclose, use, or permit access to Confidential Information except as necessary to perform your obligations under this Agreement. Confidential Information does not include information that (a) is publicly available without your breach, (b) you rightfully received from a third party without confidentiality obligations, or (c) you independently developed without use of Confidential Information. These obligations survive termination of this Agreement.
- Notices. To Jobstream: help@getjobstream.com, 286 Madison Avenue, New York, NY. To you: your account email.
- Force majeure. No liability for delays/failures due to causes beyond reasonable control (except due payments).
- Waiver & severability. Failure to enforce isn't a waiver; if any term is unenforceable, the rest remain in effect.
- No duty to monitor. We have the right, but not the obligation, to monitor, screen, review, edit, refuse, or remove any content or Joblinks at any time and for any reason. We are not liable for content provided by creators or other third parties, and our failure to remove particular content does not waive our right to do so.
- Entire agreement; survival. This Agreement + Policies is the entire agreement; sections that should survive, do.
16) Acceptable Use - Examples (Non-Exhaustive)
- Allowed: Job roundups with clear disclosures; IG/TikTok posts and Stories; Slack/Discord job channels; timely newsletter sections.
- Not allowed: Cookie stuffing; sub-affiliating; reposting expired jobs; misleading compensation/location; "apply to win a gift card"; scraping ATS pages; taking Jobstream™ CPA deals off-platform; using bots, scrapers, or automated tools against the Services; unauthorized access to any account or data; circumventing tracking, geo-filters, or security measures; harassment or abusive messaging; doxxing or sharing others' personal information; impersonation or misrepresented identity; sharing or selling account access.
17) Enforcement; Injunctive Relief
You acknowledge that any breach or threatened breach of the provisions of these Terms relating to unauthorized access, security, scraping or circumvention, confidentiality, intellectual property, harassment, or misuse of data may cause Jobstream irreparable harm for which monetary damages would be inadequate. Accordingly, in addition to any other remedies available at law or in equity, Jobstream shall be entitled to seek injunctive relief, specific performance, and other equitable remedies in any court of competent jurisdiction to prevent or stop such conduct, without the necessity of posting a bond or proving actual damages. Jobstream shall also be entitled to recover its reasonable attorneys' fees, costs, and expenses incurred in investigating, enforcing, or remedying any actual or threatened violation of these provisions.
18) Liability limitations
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Jobstream™ and its affiliates make no representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
Except as prohibited by law, Jobstream™ and its affiliates, agents, and merchants shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including without limitation any loss of profits, revenue, data, goodwill, or other intangible losses, or for any loss, interruption, or recovery of data, or any breach of data or system security, whether based on contract, tort (including negligence), strict liability, or otherwise, even if Jobstream™ has been advised of the possibility of such damages.
In all cases, Jobstream™'s total aggregate liability to you for any claims arising out of or related to your use of the Services or participation in the program shall not exceed the total Commissions paid to you in the twelve (12) months immediately preceding the event giving rise to the claim. This limitation applies regardless of the form of action or the number of claims, and even if any limited remedy fails of its essential purpose.
You acknowledge and agree that this limitation of liability reflects a reasonable allocation of risk and that Jobstream™ would not provide the Services or permit participation in the program without it. Nothing in these Terms limits or excludes Jobstream™'s liability for death or personal injury resulting from its negligence, or for fraud or fraudulent misrepresentation.
19) Press releases
You will not issue any press release or make any other public statement regarding your participation in the Program or the terms of these Terms without the prior written consent of Jobstream™.
20) Non-Disparagement
You agree that during your participation in the Jobstream™ program and for a period of two (2) years following termination of your participation for any reason, you will not make, publish, or encourage any statements, comments, posts, or content — whether public or private, written or verbal, direct or indirect — that disparage, defame, or otherwise harm the reputation of Jobstream, Predictable Source LLC, or any of their respective officers, directors, employees, partners, or affiliates.
This includes but is not limited to statements made on social media platforms, podcasts, newsletters, YouTube, or any other public or private channel or community, whether under your own name, a pseudonym, or anonymously.
Nothing in this section prohibits you from: (a) making truthful statements in connection with a legal or regulatory proceeding; (b) reporting potential violations of law to a government agency; or (c) exercising any rights that cannot be waived under applicable law.
Jobstream™ agrees to the same standard of non-disparagement with respect to you. We will not make public statements designed to harm your reputation as a creator, provided that factual reporting of policy violations, fraud findings, or legal proceedings shall not constitute disparagement.
21) Dispute resolution
PLEASE READ CAREFULLY: THIS SECTION AFFECTS YOUR LEGAL RIGHTS.
- Informal first. Email help@getjobstream.com; we'll try to resolve it within 30 days.
- Arbitration. Any dispute will be resolved by binding arbitration under the AAA Commercial Rules (English), seated in Delaware (or virtual).
- Class waiver. Claims must proceed individually; no class or representative actions.
- Opt-out. You may opt out within 30 days of account creation by emailing help@getjobstream.com with subject "Arbitration Opt-Out," including your full name, channel handle(s), and account email.
- Governing law. Delaware law governs (excluding conflicts rules); the Federal Arbitration Act governs the arbitration clause.
You and we agree that all disputes related to the Program or the Terms shall be resolved by binding arbitration. The Federal Arbitration Act and federal arbitration law and the laws of the State of Delaware without regard to principles of conflict of laws, will govern these Terms and any disputes arising between you and us. To the extent that any claim is permitted to be filed in a court of law, you and we consent to the exclusive jurisdiction and venue of the state and federal courts of Delaware. Notwithstanding the foregoing, we may elect to forego arbitration with respect to any intellectual property infringement or misappropriation claim, a claim for any actual or alleged breach of confidentiality, or a claim for breach of the indemnification obligations.
By entering into these Terms or participating in the Program or other Jobstream™ service, you hereby irrevocably waive any right you may have to join claims with those of others in the form of a class action or similar procedural device. To the fullest extent permitted by applicable law, no arbitration of a dispute related to the Program or these Terms will be joined to an arbitration involving any other party subject to any equivalent or similar terms or otherwise participating in the Program or other Jobstream™ service, whether through class arbitration proceedings or otherwise.
No arbitration proceeding or other legal action may be commenced regarding any disputes arising out of, relating to or connected with these Terms, the Program or any part of the Jobstream™ service more than one (1) year after the date that the alleged breach or other grounds for dispute originally occurred.

22) General provisions (additional terms)
You acknowledge and agree that you are operating as an independent contractor and are not a partner, franchisee, agent, employee or joint venturer of Jobstream™. This is not an exclusive relationship or agreement. We reserve the right to provide the Jobstream™ Property to other individuals or utilize the Jobstream™ Property ourselves, even if such use by another individual or our use would be competitive to your Site. Any failure by either you or us to insist upon or enforce strict performance of any provisions of these Terms shall not be construed as a waiver of any provisions or right. Neither the course of conduct between any member nor trade practices shall act to modify any provision of these Terms. These Terms constitute the entire agreement between us with respect to your participation in the Program. You shall not assign or sub-contract or purport to assign or sub-contract these Terms or any of your rights or obligations thereunder without our prior written consent. We may assign or sub-contract these Terms or any of our rights or obligations contained herein. If any term or condition of these Terms shall become or shall be declared by any court of competent jurisdiction to be invalid or unenforceable in any way, such invalidity or unenforceability shall in no way impair or affect any other term or condition all of which shall remain in full force and effect.
